Books

Judging statutes is a book of practical importance that has conclusions that generally should be taken as common sense. Judging Statute’s main conclusion, is that when reading statutes, it is important to start with the text, and to use general cannons of construction to decipher meaning. However, when ambiguity continues or there is a poorly written statute, it can be helpful to look at legislative history or other relevant means of understanding. This makes sense, there should always be the goal to get to the true intent of a statue or to get to any intended result. This way of solving an issue of ambiguity generally follows any scientific method, or any problem-solving method that anyone would use in a practical life problem. Starting as broadly and generally as possible (i.e., the text of a statute) and moving further into the details to determine a purpose (i.e. committee reports).

Robert Katzmann does a good and thorough job of explaining the issue, and laying out a persuasive case for how this could best be implemented by the courts. Taking a measured approach in which judges should think carefully, and thoughtfully when looking to include extraneous information seems to be a safe way to ensure that courts do not quickly look to inject their own opinions and sensibilities into legislation. Nevertheless, there are people much more powerful than me, who have studied the law for much longer than I have, who seem come to vastly different conclusions… (this is a portion of my book club book review)
